1. All orders placed are subject to current availability and purchases will only be  when gallery staff have checked that work is available and subject to clearance and authorization of credit card details.
  2. All delivery rates and arrangements published are subject to gallery staff checking that our normal carriage arrangements are appropriate for the works selected. Gallery staff will contact the customer to seek agreement to any modifications proposed by the gallery. In such cases purchased orders will only be processed when the customer has agreed any such new arrangements.
  3. Our terms and conditions of sale and all other matters concerning the asiatrendgallery.com website are subject to the law of Singapore where jurisdiction shall fall.
  4. The risk in Goods shall pass to the Buyer upon delivery of the Goods or upon the Goods being appropriated to the Buyer but kept at the Seller's premises at the Buyer's request.
  5. The Seller remains the owner of the Goods affected by the Contract until the Seller has been paid in full for such Goods.
  6. If any payment due under these Conditions is overdue in whole or in part, the Seller may without prejudice to any of its other rights recover and/or re-sell the Goods or any of them and may enter on the Buyer's premises by its servants or agents to recover the Goods and the Buyer shall be liable for all the Seller's costs of so doing.
  7. The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller within 48 hours of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do this he is deemed to have accepted the Goods.
  8. Any Goods in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packing at the Buyer's risk and either a) retained by the Buyer for a reasonable period to enable the Seller or its agent to inspect or Collect the Goods or b) at the Seller's option returned by the Buyer to the Seller who will refund the cost of postage and packing to the Buyer if the Goods are in fact defective.
  9. In the event of loss or damage to works in transit to the customer, and upon satisfactory vouching of that fact, the contract of sale shall terminate and asiatrendgallery.com shall refund the price paid and carriage paid by the customer forthwith.
  10. The customer may return works and seek a full refund of the purchase price paid [ but not carriage paid ] provided the return is instructed within 7 days of the customer taking delivery of the work. Return carriage and carriage arrangements to asiatrendgallery.com in such cases is the responsibility of the customer.
  11. The customer accepts responsibility for any taxation or charges levied in respect of importation of works they have ordered.
  12. Copyright in all images on the asiatrendgallery.com website vests in the artists and gallery as the case may be and in no case may any party reproduce such images.
  13. Gift vouchers issued by asiatrendgallery.com are valid up to the expiry date indicated on the voucher.
  14. Published delivery timescales are for guidance only.
  15. Transactions will be processed in Singapore Dollars (SGD) at the prevailing rate of exchange operated by our clearing merchant bank. In the event that the gallery provides approximate conversion rate information in foreign currency this shall be for general guidance only.
  16. Except as may be implied by law where the Buyer is dealing as a consumer, in the event of any breach of these Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods.
  17. In no event will asiatrendgallery.com be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Apple has been advised of the possibility of such damages.
  18. In the event of a dispute between the Buyer and the Seller, should the Seller in writing require, the Buyer agrees to submit the dispute to arbitration in accordance with the Arbitration Act for the time being in force as a legally binding alternative to Court action.
  19. In the event of our bank informing us that any credit card provided by a customer has been used without authority or otherwise improperly used the customer shall be obliged to return works forthwith.

  21. The Seller will not be under any liability whatsoever in the event that the Seller is prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond the Seller's control.
